Intellectual property and marketing law
Intellectual property rights, such as trademarks, often constitute one of the most important and valuable assets of a company. In an increasingly international market, intellectual property rights also serve as a valuable and important competitive tool.
A company's intellectual property assets can consist of ideas, technical solutions, trademarks, or the appearance of products, and these can be protected through patents, trademark protection, and copyright, among other means.
A business owner who wants to protect their assets usually needs to apply for and register their rights. The Swedish Patent and Registration Office (PRV) is the authority in Sweden that registers trademarks, designs, and grants patents. Similarly, other authorities such as WIPO handle international trademark and design registrations, while EUIPO manages EU trademarks and EU designs.
The type of protection relevant for a business owner depends on what has been created. A product or idea can often be protected in several ways, for example, through a patent for the technical solution and design protection for its appearance.
Simply put, the different types of protections are categorized as follows:
A new technical innovation or solution to a problem can be protected by a patent.
Trademark protection provides businesses with protection for the signs used for their products or services.
Artistic expressions, such as music, literature, or computer programs, may be eligible for protection through copyright.
An innovative design, shape, or pattern can be protected as a design right, applicable to both industrial and craft products.
Marketing law can, for example, provide protection against third-party use of misleading copies, derogatory statements, and exaggerated claims about product properties.
