Permission for 20 km of flood barriers to be constructed on the Falsterbo Peninsula granted by the Swedish Land and Environment Court
On 7th May 2020, the Swedish Land and Environment Court granted Vellinge municipal council permission to erect flood defence barriers along approximately 20 kilometres of the Falsterbo Peninsula coastline.
The decision of the court is an issue of fundamental interest with regard to the balancing of interests which more extensive flood protection measures necessarily raise. In summary, the court found that the locations for the barriers, for which permission was applied and granted, achieve an appropriate balance between conservation of the ecological interest in respect of nature reserves and Natura 2000 sites on the one hand, and the interest of not intruding unnecessarily on private residential land on the other, and also ensuring that protection of properties from flooding will be achieved.
Mikael Wärnsby, Sara Andersson and Tor Pöpke from Lindahl’s environmental law team are the representatives for the applicant.
