Lindahl represented Trelleborgs Hamn in a new success against Rover Maritime

The new dispute concerns the same construction contract as the earlier arbitration, but relates to claims that Trelleborgs Hamn acquired from Peab, which had been engaged by Rover Maritime as a subcontractor for parts of the work.

The case has raised several key issues of construction law, including the right to compensation for variation works (ÄTA work), extensions of time and hindrances, and liquidated damages for delay. The District Court awarded full compensation for all variation work claims and found that Peab was entitled to an 18-week extension of time. Rover Maritime was found not to be entitled to compensation in the form of liquidated damages for delay.

The District Court ordered Rover Maritime to pay approximately SEK 29 million plus interest to Trelleborgs Hamn, meaning that Trelleborgs Hamn achieved full success on its claimed principal amount. Rover Maritime must also reimburse Trelleborgs Hamn for legal costs of just over SEK 4.1 million.

The ruling follows the arbitral award issued in June 2025 in a separate dispute between Trelleborgs Hamn and Rover Maritime concerning the same construction contract. In that dispute too, Trelleborgs Hamn achieved significant success and was represented by Lindahl. Rover Maritime was then awarded SEK 0 of its claim of approximately SEK 145 million relating to compensation for variation work and hindrances, while Trelleborgs Hamn was awarded just over SEK 35 million in liquidated damages for delay.

The judgment may be appealed.
