When it comes to industrial facilities, where careful planning and significant investments are necessary, the choice of contract plays a central role. SSG 2019-03 and ABA 99 are two prominent Swedish standard contracts that regulate the construction of industrial facilities. ABA 99 is known for having a good structure but is also supplier-friendly, where the supplier's liability for defects is limited and penalties for breach of contract are exclusively regulated in the agreement. This means that the client has limited possibilities to claim compensation in case of the supplier's breach of contract.
SSG 2019-03 gives the client a stronger position by offering more possibilities for penalties, including the right to claim compensation for any losses and damages that may arise due to the supplier's breach of contract. The agreement also contains other provisions that benefit the client, such as requiring the supplier to provide spare parts for at least ten years after the project has been taken over. At the same time, SSG 2019-03 has a different, problematic procedure for the takeover and approval of the facility, and the terms are more difficult to overview.
