Lund District Court today handed down a judgement in a case between Höör Municipality and Atkins Sverige AB. The case concerned Atkins' liability for errors in a bill of quantities drawn up by Atkins for the municipality's procurement of a construction contract. The court's examination has concerned issues such as (i) when estimated quantities in a bill of quantities can be deemed to constitute an error that entails liability for the consultant, (ii) whether the client is obliged to check information in a bill of quantities supplied by the consultant and (iii) which changes and additions to the measurement and remunerations regulations (MER Anläggning 13) must be included in a separate document or contract in order for it to be valid. The municipality's action for damages against Atkins was fully upheld, and Atkins was ordered to reimburse the municipality, firstly in the form of damages amounting to the liability limit in the General Conditions of Contract for Consulting Agreements for Architectural and Engineering Assignments (ABK 09), and secondly for the municipality's legal costs in the case.
